New Job-Protected Leave for Serious Illness: Ontario’s Latest Employment Law Update

Ontario is making a significant change to employment standards with the introduction of new long-term illness leave rules. As part of the Working for Workers Six Act, 2024, which takes effect on June 19, 2025, this amendment provides employees with the right to take up to 27 weeks of unpaid, job-protected leave within a 52-week period if they are unable to work due to a serious medical condition.


This new leave entitlement is designed to support employees facing major health challenges—without the added stress of losing their job.


Who is eligible?

To qualify for long-term illness leave, an employee must:

  • Have been employed by their employer for at least 13 consecutive weeks; and

  • Provide a medical certificate from a qualified health practitioner confirming:

    • That the employee has a serious medical condition, and

    • The expected duration of the leave.


The 27 weeks of leave do not have to be taken consecutively—employees can use the time intermittently or in chunks—but all time off must fall within a single 52-week period.


What this means for employers

For employees, this represents a meaningful shift toward greater job security during times of illness. For employers, it brings new administrative responsibilities—such as managing coverage during extended absences and ensuring remaining team members aren’t overburdened.

Perhaps most importantly, employers are required to reinstate employees to their original position (or a comparable one) once they are medically cleared to return to work.
